1. Agreement
These Terms of Service ("Terms") govern your use of Xiaoya Growth Partner (the "Service"), a web application available at our website. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and accounts
- You must be at least 18 years old to create an account. Accounts are for parents and legal guardians.
- You are responsible for the accuracy of your account information and for keeping your password confidential.
- You are responsible for activity that happens under your account.
- One account may be used within one household. Do not share your login with people outside your household or resell access.
- You may delete your account at any time by emailing us.
3. What the Service is
Xiaoya Growth Partner provides short, human-written illustrated stories for children roughly aged 5–10, a conversation prompt for the parent, and one practical real-world action per day. The Service also displays progress, habits, and a virtual companion that grows with completed actions.
The Service is an educational and entertainment product for family use. It is not medical, psychological, therapeutic, or diagnostic advice, and it does not replace professionals. If your child needs medical or psychological support, consult a qualified professional.
The Service does not generate images, video, or text using AI at runtime, does not host user-generated public content, and has no social, messaging, or publishing features. No third-party content moderation API is therefore applicable.
4. Plans and pricing

Prices are in US dollars and are shown before purchase. We may change prices in the future; a price change never applies to a billing period you have already paid for, and we will show the new price before any renewal charge.
5. Billing, renewals, and Merchant of Record
- Payments are processed by Creem, which acts as Merchant of Record. Your payment is a transaction with Creem, and Creem's name appears on your statement.
- Paid subscriptions renew automatically at the end of each billing period at the price you agreed to, until you cancel.
- You can cancel at any time. Cancellation stops future charges and keeps your access until the end of the period you already paid for.
- You can cancel or manage your subscription yourself at any time. In the app, open Account Settings → Subscription & Billing → Manage or cancel subscription; this opens the Creem Customer Portal, where you can cancel, change your payment method, and download invoices.
- You can also email nexoralabs392@gmail.com from the address on your account. We act on cancellation requests within 2 business days.
- Refunds are handled in line with Creem's buyer terms and applicable consumer law. If you believe you were charged in error, contact us and we will work with Creem to resolve it.
- We may suspend or cancel a subscription immediately if payment fails or if these Terms are breached.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, fraudulent, or high-risk purpose, or in any way that violates the Creem prohibited products and acceptable use rules.
- Copy, scrape, resell, sublicense, or redistribute the stories, text, illustrations, or any other content, or make the Service available to the public as your own product.
- Attempt to access accounts, data, or systems that do not belong to you, or bypass authentication, row-level security, or payment controls.
- Reverse engineer, overload, probe, or disrupt the Service or its infrastructure.
- Upload or submit content that is illegal, hateful, sexual, or harmful to children.
We may suspend or terminate access for a breach of this section.
7. Content and intellectual property
All stories, illustrations, characters, text, and software in the Service are owned by us or our licensors and are protected by copyright. You receive a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for private, non-commercial family use during your subscription. All rights not expressly granted are reserved.
8. Availability and changes
We aim to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may add, change, or remove features, and we may suspend the Service for maintenance. If we discontinue the Service entirely, we will provide reasonable notice and refund any prepaid unused period.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any particular educational, behavioral, or developmental outcome.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total aggregate liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law, or limits mandatory consumer rights in your country of residence.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections on intellectual property, disclaimers, limitation of liability, and governing law survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules, except where mandatory consumer protection law in your country of residence gives you stronger rights. Before starting formal proceedings, please contact us so we can try to resolve the issue directly.
13. Changes to these Terms
We may update these Terms. If a change is material, we will update the effective date and notify you by email or in the app. Continued use after the effective date means you accept the updated Terms.

本服务条款（下称"条款"）适用于你对「小芽成长伙伴」（下称"本服务"）的使用。创建账号或使用本服务，即表示你同意本条款及隐私政策。如不同意，请勿使用本服务。
二、资格与账号
- 创建账号须年满 18 周岁。账号面向家长及法定监护人。
- 你需对账号信息的真实性负责，并妥善保管密码。
- 你需对账号下发生的活动负责。
- 一个账号限一个家庭使用。请勿与家庭以外的人共享登录信息或转售访问权。
- 你可随时通过邮件申请删除账号。
三、服务内容
本服务提供面向约 5–10 岁儿童的原创短篇成长故事、给家长的对话提示，以及每天一个现实中的小行动，并展示成长进度、习惯与虚拟伙伴。本服务是面向家庭的成长教育类产品，不构成医疗、心理、治疗或诊断建议，也不能替代专业人员。如孩子需要医疗或心理支持，请咨询专业人士。
本服务不在运行时使用 AI 生成图像、视频或文本，不承载用户公开发布的内容，也不含社交、私信或发布功能。因此不涉及第三方内容审核 API 的适用要求。
四、套餐与价格

价格以美元标示，并在购买前清晰展示。我们未来可能调整价格；价格调整不会影响你已付款的计费周期，且在任何续费扣款前会先显示新价格。
五、计费、续费与记录商户
- 支付由 Creem 处理，Creem 是交易的记录商户（Merchant of Record）。你的付款是与 Creem 之间的交易，账单上显示 Creem。
- 付费订阅在每个计费周期结束时自动续费，价格为你已同意的价格，直至你取消。
- 你可随时取消。取消后不再产生后续扣款，已付费周期的访问权保留至周期结束。
- 你可以随时在产品内自助取消或管理订阅：打开应用 → 账户设置 → 订阅与账单 → 取消/管理订阅，会跳转到 Creem 客户门户，可取消订阅、更换支付方式、下载发票。
- 也可以用账号注册邮箱发送邮件至 nexoralabs392@gmail.com，我们会在 2 个工作日内处理取消请求。
- 退款按 Creem 的买家条款及适用的消费者法律处理。如你认为扣款有误，请联系我们，我们会与 Creem 一同解决。
- 如付款失败或违反本条款，我们可立即暂停或取消订阅。
六、可接受使用
你同意不进行以下行为：
- 将本服务用于违法、有害、欺诈或高风险用途，或以违反 Creem 禁售产品与可接受使用规则的方式使用。
- 复制、抓取、转售、再授权或再分发故事、文本、插画及其他内容，或将本服务作为你自己的产品对外提供。
- 试图访问不属于你的账号、数据或系统，或绕过身份验证、行级安全策略与支付控制。
- 逆向工程、超载、探测或破坏本服务及其基础设施。
- 上传或提交违法、仇恨、色情或对儿童有害的内容。
如违反本节，我们可暂停或终止你的访问。
七、内容与知识产权
本服务中的全部故事、插画、角色、文本与软件归我们或我们的许可方所有，受著作权法保护。你获得一项有限的、个人的、非排他的、不可转让的、可撤销的许可，仅可在订阅期内用于私人非商业的家庭用途。未明确授予的权利均予保留。
八、可用性与变更
我们力求服务持续可用，但不保证无中断或无错误。我们可能新增、调整或移除功能，也可能因维护暂停服务。如我们完全停止本服务，会提前合理通知，并退还未使用的预付期间费用。
九、免责声明
本服务按"现状"和"可用"状态提供，不作任何明示或默示担保，包括可商用性、特定用途适用性与不侵权担保。我们不保证任何特定的教育、行为或发展结果。
十、责任限制
在法律允许的最大范围内，我们不对间接、附带、特殊、后果性或惩罚性损害，以及利润、数据或商誉损失承担责任。就本服务相关索赔，我们的累计责任上限为你主张事由发生前 12 个月内向我们支付的金额。本条款不排除法律不得排除的责任，也不限制你所在国强制性消费者权利。
十一、终止
你可随时停止使用并删除账号。如你违反本条款、法律要求或我们停止服务，我们可暂停或终止你的访问。知识产权、免责声明、责任限制与适用法律条款在终止后继续有效。
十二、适用法律与争议
本条款适用中华人民共和国法律（不考虑法律冲突规则），但你所在国强制性消费者保护法赋予你更强权利的情形除外。在提起正式程序前，请先联系我们，我们尽力直接解决。
十三、条款变更
我们可能更新本条款。如属重大变更，我们会更新生效日期，并通过邮件或应用内通知你。生效日期后继续使用即表示接受更新后的条款。
